By accessing our website, requesting a quotation, approving a proposal, making a payment, or engaging GTATION for any service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
GTATION is a digital agency providing professional services including digital marketing, social media marketing, branding, graphic design, content creation, search engine optimization (SEO), paid advertising, website design and development, custom web application development, and other related digital solutions.
The exact scope of each project will be determined by the quotation, proposal, service agreement, invoice, or other written communication approved by both GTATION and the client.
Before starting a project, GTATION may provide a proposal, quotation, project scope, package description, estimated timeline, or service agreement.
Once the client approves the scope or makes an advance/payment toward the project, the project will be considered officially confirmed.
Any service, feature, revision, integration, or deliverable that is not included in the agreed scope may be treated as additional work and may require additional cost and delivery time.
Clients are responsible for providing accurate and complete information required to execute the project, including business information, brand assets, content, product details, images, login credentials, approvals, and other necessary materials.
The client must ensure that any materials supplied to GTATION are legally owned, properly licensed, or authorized for use.
Delays in providing information, content, approvals, credentials, or feedback may affect the project timeline, and GTATION will not be responsible for delays resulting from incomplete or late client responses.
Project payment terms will be mentioned in the relevant quotation, proposal, invoice, or agreement.
Where an advance payment is required, work will begin only after the agreed advance has been received.
Remaining balances must be paid according to the agreed payment schedule. GTATION reserves the right to pause development, withhold final files, suspend services, or delay website deployment until outstanding payments are cleared.
Payments already made for completed work, reserved resources, subscriptions, third-party costs, or commenced services may be non-refundable.
Any request outside the originally approved project scope may be considered additional work.
Examples include major design changes after approval, additional pages, additional features, new integrations, additional product uploads, extra campaign requirements, extensive content changes, or functionality not included in the original package.
GTATION may provide a separate quotation and revised timeline for such requirements.
The number of revisions included in a project will depend on the selected package or approved proposal.
Revisions are intended for reasonable adjustments to the originally approved concept and do not include complete redesigns, changes in project direction, or development of entirely new concepts.
Additional revisions beyond the agreed limit may be charged separately.
GTATION will make reasonable efforts to complete projects within the estimated delivery timeline.
However, project timelines may be affected by client delays, additional requirements, technical complications, third-party services, hosting issues, platform changes, approval delays, force majeure events, or circumstances outside GTATION’s reasonable control.
Estimated delivery dates should therefore not be considered absolute guarantees unless explicitly stated in a separate written agreement.
Websites and web applications may be developed using technologies or platforms such as WordPress, WooCommerce, React.js, Next.js, MongoDB, Supabase, APIs, third-party plugins, themes, frameworks, or other appropriate technologies depending on project requirements.
GTATION is responsible for delivering the functionality agreed within the project scope.
Future compatibility issues caused by third-party updates, hosting environments, browsers, operating systems, APIs, plugins, themes, platform policies, or external software may require additional maintenance.
Domain registration, web hosting, email hosting, premium plugins, themes, software licenses, APIs, payment gateways, SMS services, cloud services, advertising platforms, or other third-party tools may involve separate fees.
Unless specifically included in the proposal, these costs are the responsibility of the client.
GTATION is not responsible for downtime, data loss, security incidents, service interruptions, account suspensions, pricing changes, or policy changes caused by third-party service providers.
Digital marketing performance depends on numerous factors, including market conditions, audience behavior, competition, advertising budget, offer quality, website performance, platform algorithms, creative performance, and client business operations.
GTATION does not guarantee a specific number of leads, sales, followers, website visitors, rankings, conversions, or revenue unless explicitly stated in writing.
Marketing decisions will be made based on available data, professional experience, testing, optimization, and agreed campaign objectives.
Advertising budgets for platforms such as Meta, Google, LinkedIn, TikTok, or other advertising networks are separate from GTATION‘s service or management fees unless clearly stated otherwise.
Clients are responsible for funding their advertising spend and any applicable taxes, transaction charges, exchange-rate differences, or platform fees.
Advertising platforms operate independently, and GTATION cannot guarantee approval of any advertisement, account, campaign, or business asset.
SEO is a long-term process and search engine rankings cannot be guaranteed.
Search engines may update their algorithms, ranking systems, policies, or indexing processes at any time.
GTATION will use professional SEO practices to improve website visibility and performance, but does not guarantee a specific ranking position, traffic volume, or timeframe for results.
Upon full payment, the client will receive rights to the final deliverables specifically created for their project, subject to any third-party licensing restrictions.
GTATION retains ownership of its internal processes, development methods, reusable code components, templates, frameworks, concepts, tools, knowledge, and intellectual property developed independently of the client’s project.
Third-party assets such as stock photography, fonts, plugins, themes, software, libraries, templates, and licensed materials remain subject to their respective licensing terms.
Unless otherwise agreed in writing, GTATION may display completed project work, client names, logos, website previews, campaign creatives, or other publicly available project materials in its portfolio, website, social media, proposals, presentations, or promotional materials.
Clients who require confidentiality regarding portfolio publication should notify GTATION in writing before project commencement.
GTATION will take reasonable steps to protect confidential business information, credentials, documents, strategies, and materials received from clients.
Both parties are expected to maintain confidentiality regarding non-public information shared during the project.
Confidentiality obligations do not apply to information that is already publicly available, independently developed, lawfully received from another source, or required to be disclosed by law.
Clients should provide access only to accounts necessary for project execution and should change sensitive passwords after project completion where appropriate.
GTATION will take reasonable precautions when handling credentials but cannot be held responsible for security incidents caused by weak passwords, unauthorized third-party access, compromised client devices, external attacks, hosting vulnerabilities, or actions outside GTATION’s control.
Post-project support will be provided according to the support period included in the applicable package or agreement.
Support generally covers issues related to the delivered work and does not automatically include new features, redesigns, new content, third-party problems, hosting management, malware removal, platform migrations, or ongoing maintenance unless these services have been separately agreed.
After the included support period ends, additional support or maintenance may be chargeable.
If a client chooses to cancel a project after work has started, payments made for work already performed, planning, research, design, development, third-party purchases, or allocated resources may not be refundable.
GTATION reserves the right to terminate or suspend a project where there is repeated non-payment, abusive behavior, unlawful activity, prolonged lack of communication, misuse of services, or material breach of agreed terms.
Any outstanding fees for completed work remain payable.
Refund eligibility will depend on the nature and stage of the service.
Completed services, approved work, commenced campaigns, design work already delivered, development already completed, third-party purchases, advertising spend, software licenses, domain or hosting costs, and other non-recoverable expenses are generally not refundable.
Where a refund is applicable, GTATION will determine the amount based on work completed and costs already incurred.
GTATION makes reasonable efforts to ensure that information published on its website is accurate and current.
However, service descriptions, package features, pricing, technologies, availability, and other information may change without prior notice.
A formal quotation or proposal issued directly to a client will take precedence over general information displayed on the website where differences exist.
GTATION will not be responsible for indirect, incidental, consequential, or business losses resulting from the use or inability to use its services.
This may include loss of profits, revenue, data, customers, rankings, advertising performance, business opportunities, or reputation arising from third-party platforms, hosting providers, software failures, cyber incidents, algorithm updates, account restrictions, or circumstances beyond GTATION’s reasonable control.
Where permitted by applicable law, GTATION’s total liability relating to a specific project will not exceed the amount paid by the client to GTATION for the relevant service.
Clients may not use GTATION’s services to support unlawful, fraudulent, deceptive, abusive, harmful, infringing, or unauthorized activities.
GTATION reserves the right to refuse or discontinue services where a project violates applicable law, third-party policies, intellectual-property rights, or professional standards.
GTATION may update these Terms & Conditions from time to time to reflect changes in services, business practices, technologies, or legal requirements.
The latest version will be published on this page with an updated revision date.
Continued use of our website or services after changes are published constitutes acceptance of the revised Terms & Conditions.
These Terms & Conditions will be governed by and interpreted in accordance with the applicable laws of Bangladesh, unless a separate written agreement specifies otherwise.
